Judgments on Memorials before 2022

Dilhorne All Saints - February 2021

The petitioner applied for a faculty in respect of the installation in the churchyard of a memorial of red granite polished on the face, bearing gold lettering and 1220mm high. The Chancellor approved the faculty to issue on the grounds that a) the use of gold lettering in the churchyard was widespread and b) although there are only a small number of memorials of polished red granite, including the memorial on the plot next to the grave in question, the churchyard contains memorials of a variety of types of stone therefore the use of polished red granite would neither be unsightly nor jarring.

Canwell St Mary St Giles and All Saints - January 2020

A judgment in respect of a petition to install an additional memorial tablet to someone who is not interred in the churchyard, that bears a Masonic symbol. The petition was dismissed in its current form. However, the Chancellor permitted the petitioner to install a memorial tablet, that was similar in dimensions and size, to be installed but that tablet could not bear a Masonic symbol and would need to reference the fact that the deceased is interred elsewhere.

Alton with Bradley le Moors St Leonard - December 2019

A judgment in respect of a petition to install a memorial made of local stone, to be rough hewn in appearance and to be upright in a wedge or pyramidical shape, with a bronze plaque attached to it, bearing a verse of Byron's poetry. The Chancellor granted the faculty for the material of the stone but did not authorise the verse of poetry. The petitioner was advised that they may want to consult the incumbent with a view to identifying a suitable passage from Holy Scripture.

Horton St Michael and All Angels - June 2018

A judgment in respect of a petition for a set of kerbs and gravel, to have cremated remains scattered on top and an additional inscription added to the existing memorial. The petition was dismissed to the extent of the installation of the kerbs, gravel and scattering of cremated remains. However, the additional wording was considered by the Chancellor to be wholly appropriate and the petitioner was invited to consider burying the cremated remains, as opposed to having them scattered.

Kerbs and Vase - June 2018

A judgment in respect of a petition for a set of kerbs and an additional vase on two separate, existing graves in the same churchyard. The kerbs and additional vase were approved.

Fradswell St James the Less - May 2018

Petitioner petitioned for polished black granite memorial with gold lettering. The memorial was to have an upright column alongside and connected to the memorial, bearing an image of a cross and a rose (entwined around the cross), for almost the full height of the column. The Chancellor approved the faculty to issue.

Lichfield St Michael - January 2017

Double heart shaped memorial with images of horses head and river bank. Petition refused due to proposed size of memorial.

Tong St Bartholomew - December 2013

Memorial in churchyard - purpose of Churchyard Regulations, approach to be taken to applications for memorials outside the scope of the Churchyard Regulations. Headstone below minimum height permitted but raised kerbs refused.

Standon All Saints - June 2013

Memorial in churchyard - approach to be taken to applications for unconventional wording of inscription on memorials. Proposed wording not allowed on ground that potentially flippant and unseemly.

Eccleshall Holy Trinity - December 2014

Memorial in churchyard - purpose of churchyards, approach to be taken to applications for memorials outside the scope of the Churchyard Regulations. Pedestal memorial allowed.

Newchapel St James - April 2012

Memorial in churchyard, purpose of Churchyard Regulations, approach to be taken to applications for memorials outside the scope of the Churchyard Regulations. Petition refused but faculty granted for memorial in accordance with the dimensions and material as set out in the Judgment.

Armitage St John the Baptist - January 2017

Petition to remove tablet memorial placed on grave. Petitioners to remove said tablet memorial but to make suitable reference on memorial already in place.

Eccleshall Holy Trinity - December 2014

Adding kerbs to grave space - precedence of other graves having kerbs does permit the installation of kerbs in the future. The churchyard is maintained by volunteers and the ease with which maintenance can be carried out should be considered. Petition dismissed.
